Ratio Decidendi

The court found that the applicant made reasonable efforts to ascertain the date and outcome of the ruling, and the failure to file the Notice of Objection within the prescribed period was due to lack of notice of the ruling date. The ruling was delivered in the absence of the parties, and there was no indication by way of notice or otherwise as to when it would be delivered. The court was satisfied that the delay was excusable and that the interests of justice and fairness required the enlargement of time. Accordingly, the application was merited and the orders sought were granted.
