Miscellaneous Application / Ruling on Application for Joinder and Extension of Injunction Orders

  1. 1 Whether Kali Community Based Organization and its members should be joined as interested parties in the proceedings.
  2. 2 Whether the County Government of Meru should be joined as the 1st respondent to replace the defunct County Council of Nyambene.
  3. 3 Whether the injunction orders issued against the defunct County Council of Nyambene can be extended and enforced against the County Government of Meru.

Ratio Decidendi

The court found that Kali Community Based Organization was registered after the County Council of Nyambene had become defunct and after the original injunction orders had been issued. As such, the applicant did not exist at the material time and could not benefit from or enforce orders issued prior to its registration. Furthermore, the applicant failed to provide certified evidence of its membership or establish its legal personality sufficiently to warrant joinder. Consequently, the court declined to join the applicant or the County Government of Meru as parties, and refused to extend the previous injunction orders to the County Government of Meru.
