Ratio Decidendi

The court found that the grant of representation to the deceased's estate was confirmed on 15th July, 2004, and the estate had since been distributed to the beneficiaries. All subsequent applications for revocation of grant, including those by the applicant and his mother, had been dismissed. There was therefore nothing left for determination in the cause that would warrant substitution of parties. The application for substitution was also found to be time-barred, as it was brought more than a year after the death of the respondent. The court concluded that the application was without merit and dismissed it with costs.
