Procedural Posture

Civil Appeal / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the application for stay of execution pending appeal was filed without unreasonable delay.
  2. 2 Whether the applicant demonstrated that she would suffer substantial loss if stay is not granted.
  3. 3 Whether the applicant provided security for due performance of the decree as required by law.

Ratio Decidendi

The court found that the application for stay of execution was filed almost a year after the judgment, with no explanation for the delay, constituting unreasonable and unexplained delay. The applicant failed to demonstrate that she would suffer substantial loss, as she was not recognized as a beneficiary of the estate by the trial court and therefore could not be disinherited from property she had no legal claim to. The court held that the applicant did not meet the requirements for grant of stay under Order 42 Rule 6 of the Civil Procedure Rules, and thus the application lacked merit.
