While the deceased failed to use the designated footbridge, the respondent, as a driver, was required to exercise heightened vigilance, especially given the poor visibility and early morning hour. The existence of a footbridge did not absolve the driver from anticipating unexpected pedestrian behavior. The trial court erred in exonerating the respondent entirely; liability was therefore apportioned equally at 50% to each party.
