The court found that the appellants filed the application for stay of execution without unreasonable delay and that the respondent had not demonstrated his financial ability to refund the decretal sum if the appeal succeeded. The court determined that the proposed bank guarantee was expired and thus not valid security. In balancing the appellants' right to appeal with the respondent's right to enjoy the fruits of judgment, the court held that a conditional stay was appropriate. The appellants were ordered to pay Kshs 500,000 to the respondent for immediate needs and to deposit the balance of the decretal sum in an escrow account in the joint names of the parties' advocates within 30 days....
