The court found that the Respondent's further lists of documents were filed long after closure of pleadings and without leave of court. The consent order reopening the Respondent's case was limited to allowing the Respondent to call witnesses to present evidence already on record, not to introduce new documents. Allowing the Respondent to introduce new evidential documents at this stage would be highly prejudicial to the Claimant, who would not have an opportunity to rebut the new evidence. This would fundamentally alter the character of the case and violate the Claimant's right to a fair trial.
