The High Court found that the trial magistrate's sentence, which imposed both a compensation order with a custodial default sentence and an additional jail term, was unlawful and not supported by the Criminal Procedure Code. Section 175 only allows compensation orders to be enforced as civil judgments, and does not permit custodial sentences in default of payment. Furthermore, the additional eight-month imprisonment had no legal basis once compensation was ordered.
