Ratio Decidendi

The court found that the 1st Claimant, Musa Ndima Said, was not subjected to the disciplinary process required under Section 41 of the Employment Act and the accusations against him were not proved as required under Section 43. Therefore, his dismissal was wrongful and unfair, entitling him to compensation and notice pay. In contrast, the 2nd Claimant, Said Mohdhar Abdalla, admitted to irregularly processing a gate pass and did not testify to rebut the Respondent's case. Applying the reasonable responses test, the court held that the Respondent had a valid reason for his dismissal and followed due process, thus his claim for wrongful dismissal failed.
