The High Court, as the first appellate court, is obligated to consider any finding or order made by the tribunal that is contested on appeal, including jurisdictional questions. Jurisdiction is a threshold issue that cannot be conferred by acquiescence or participation in proceedings. Section 40(2) of the Political Parties Act mandates that disputes must first be heard and determined by a political party's internal dispute resolution mechanism before the tribunal can assume jurisdiction.
