Ratio Decidendi

The court, having noted the recent decision in Kenya National Parents Association v Cabinet Secretary Ministry of Education Jacob Kaimenyi & 2 others [2016] eKLR, recognizes that the applicant's claimed status as the national parents association under the Basic Education Act has been judicially rejected. The applicant cannot claim statutory standing or the right to manage or intervene in the administration of public schools unless it is the association contemplated by the Act. The court therefore invites further submissions from counsel on the implications of the KNPA decision for the present proceedings, as it may be dispositive of the applicant's standing and the merits of the application.
