The High Court found that the application was incompetent because it sought to review a decision already made by a court of concurrent jurisdiction, which is not permitted. Additionally, the sentence imposed (15 years imprisonment for robbery with violence) was itself illegal as the statutory sentence is death, but the court could not enhance the sentence without prior notice to the applicant. Since no notice of enhancement was given, the court maintained the status quo.
