The Tribunal found that the Tenant was in substantial rent arrears, a fact not materially challenged by the Tenant. The Tribunal held that equitable relief, such as a temporary injunction, is discretionary and not available to a party who is in breach of their principal obligation to pay rent. The Tribunal further held that while the Landlord is not permitted to lock the premises without a court order, the Landlord is entitled to levy distress for rent arrears through a licensed auctioneer. The Tenant's application for a temporary injunction was therefore not merited, and the costs of the application were awarded against the Tenant.
