The Plaintiffs had not complied with procedural requirements, nor had they served the 2nd Defendant or provided necessary documents. The court held that the delay was deliberate, inexcusable, and amounted to an abuse of the court process, causing prejudice to the 1st Defendant. The overriding objective of the Civil Procedure Act requires timely prosecution of cases, and open-ended negotiations cannot be permitted to stall litigation indefinitely....
