Ratio Decidendi

The High Court lacks jurisdiction to review or revise a sentence imposed by a court of concurrent jurisdiction (the High Court) after the matter has been determined on appeal by the Court of Appeal, a superior court. The revisionary powers of the High Court under the Criminal Procedure Code are confined to proceedings from subordinate courts. Since the applicant's conviction and sentence were affirmed by the Court of Appeal and no further appeal was made to the Supreme Court, the High Court is functus officio and cannot entertain the application for revision. Entertaining such an application would amount to sitting on appeal over a superior court's decision, which is not permitted by law.
