The High Court determined that, due to statutory amendments effective January 2, 2016, the exclusive jurisdiction previously held by the High Court to revoke all grants of representation, including those made by magistrates, was abolished. Section 23 of the Magistrates’ Courts Act, 2015 amended section 48(1) of the Law of Succession Act, extending jurisdiction to magistrates to revoke grants made by them. Consequently, when a succession cause is transferred from the High Court to the Magistrate’s Court, all orders and grants issued prior to the transfer become orders of the magistrate, who then has the authority to review, vary, or revoke them.
