The court found that the applications for stay of execution and stay of proceedings were made within a reasonable time and that the applicant stood to suffer substantial loss, including deprivation of personal liberty, if the orders were not stayed. The court held that the appeal was arguable and that refusal to grant stay would render the appeal nugatory, particularly as the applicant would have already served the sentence of civil jail. The court exercised its discretion to grant both stays, subject to the applicant setting down the appeal for hearing within ninety days, failing which the stays would lapse automatically. Each party was ordered to bear their own costs.
