Procedural Posture

Preliminary Objection / Ruling on Preliminary Objection

  1. 1 Whether the Employment and Labour Relations Court has jurisdiction to hear the petition before exhaustion of statutory dispute resolution mechanisms.
  2. 2 Whether the preliminary objection meets the threshold where facts regarding employment relationship are disputed.

Ratio Decidendi

The court found that the facts regarding the petitioners' employer were disputed, as the petitioners claimed employment by Kakamega County Water and Sanitation Company and not the County Public Service Board. Since the determination of the employer is a factual issue, the preliminary objection, which is only sustainable on pure points of law, could not be upheld. The court held that it has original jurisdiction to determine employment disputes where facts are in dispute, and the doctrine of exhaustion does not apply where the factual basis for jurisdiction is unsettled. Therefore, the preliminary objection was dismissed as it did not meet the threshold required for such objections.
