Ratio Decidendi

The court found that the claimant's claim was based on a continuing breach of contract, as he alleged non-payment of dues over a period culminating in April 2016. Under section 90 of the Employment Act, 2007, claims based on continuing injury must be filed within twelve months of cessation. The claimant filed suit on 25 February 2019, more than twelve months after cessation in April 2016. The court held that the suit was time barred and dismissed it. The court also considered that the preliminary objection was not raised promptly and therefore ordered each party to bear its own costs.
