The court held that although jurisprudence allows for judicial discretion in sentencing, including the possibility of departing from statutory minimums, the sentence of twenty years imprisonment for defilement was appropriate and proportionate to the offence committed. The court found no sufficient mitigating factors to warrant reduction of the sentence. However, the court ordered that the time the appellant spent in remand custody from March 13, 2020, be taken into account in compliance with section 333(2) of the Criminal Procedure Code. The appeal on sentence was therefore dismissed, and the original sentence was upheld subject to credit for remand time.
