The Applicant failed to prove, to the required standard, that the 1st and 2nd Respondents wilfully and deliberately disobeyed the court order. The alleged destruction of boundary features, if it occurred, constitutes a criminal offence under the Land Registration Act and not contempt of court. Therefore, the court held that it was not the appropriate forum for redress regarding the destruction of boundary features and dismissed the application for contempt.
