Ratio Decidendi

The court found that the error by Mr Onsando Osiemo regarding the date of death of Joseph Rioba was a genuine mistake and not an intentional act of perjury. The court exercised its discretion to allow the recall of the witness for re-examination, holding that this would not prejudice the parties and would serve the interests of justice. The court rejected the plea to strike out the entire evidence of Mr Osiemo, finding such a remedy too drastic in the absence of fraud or intent to mislead.
