Ratio Decidendi

The court found that the applicants had demonstrated, through affidavit evidence, that the 1st defendant's whereabouts were unknown and that personal service was not practicable. The court was satisfied that the requirements of Order 5 Rule 17(1) of the Civil Procedure Rules, 2010 had been met, justifying the grant of leave for substituted service. The court therefore allowed the application, permitting service of the summons and plaint on the 1st defendant by advertisement in the Daily Nation newspaper within 21 days, with the 1st defendant required to enter appearance within 21 days of the advertisement. Costs were ordered to be in the cause.
