Procedural Posture

Tribunal Claim / Judgment

  1. 1 Whether the Claimant was a member of the Respondent from 1979 and if his membership ceased in 1984.
  2. 2 Whether the Claimant is entitled to the prayers sought, including temporary injunction and general damages.

Ratio Decidendi

The Tribunal found that while the Claimant was initially a member of the Respondent, credible oral and documentary evidence established that he was expelled in 1984 for misconduct involving direct sales to tourists, contrary to society rules. The Claimant failed to provide evidence of membership or transactions with the Respondent post-1984, and admitted to a private arrangement with another member for sales. The Tribunal held that the Claimant had not discharged the burden of proof to show continued membership or entitlement to rights as a member. Consequently, the prayers for injunction and damages were not available to him, as he had no standing as a member after 1984.
