The High Court lacks jurisdiction to entertain a revision application for sentence review where the applicant had the right to appeal but failed to do so. Section 364(5) of the Criminal Procedure Code expressly bars revision proceedings in such circumstances. The applicant was convicted and sentenced after the relevant jurisprudence on mandatory minimum sentences had been established and the trial court considered all mitigating factors. Therefore, the applicant's only recourse is to file an appeal, not a revision application. The application for sentence review is thus without merit and must be dismissed.
