Ratio Decidendi

The court found that the plaintiff, having already filed and participated in consolidated Environment and Land Court suits over the same subject matter and parties, acted in abuse of the court process by subsequently filing Mavoko CMELC No. 64 of 2019 without disclosure of the pending ELC matters. The subordinate court suit was therefore sub judice. The court exercised its powers under Section 18(1) of the Civil Procedure Act to withdraw the subordinate court suit, holding that the defendants' application was merited and that the continued prosecution of the lower court suit would undermine the integrity of the judicial process and risk conflicting decisions.
