Ratio Decidendi

The court found that the respondent's payment was made after the process of execution had commenced, as evidenced by the issuance and service of warrants of attachment and a proclamation of attachment prior to the payment date. The respondent did not challenge the auctioneer's bill of costs during taxation or by reference, and thus could not contest the certified costs at the execution stage. The applicant was therefore entitled to a garnishee order absolute for the taxed costs, to be satisfied from the respondent's funds held by the garnishee bank.
