The Respondent did not provide sufficient evidence of the alleged fraudulent conduct, did not issue a notice to show cause, and did not accord the Claimant a fair hearing. The procedural requirements under Section 41 of the Act were not met, rendering the termination both substantively and procedurally unfair. The Claimant was therefore entitled to a declaration of unfair termination, three months' salary in lieu of notice, and compensation equivalent to six months' gross salary.
