The applicants. reliance on letters of allotment was insufficient to challenge the respondent. s registered title. Since both limbs of Rule 5(2)(b) must be satisfied for a stay of execution to be granted, and the applicants failed to establish the first limb (arguable appeal), the court did not consider whether the appeal would be rendered nugatory. The application for stay was therefore dismissed with costs to the respondent.
