Procedural Posture

Criminal Petition / Ruling on Resentencing Petition After Exhaustion of Appeals

  1. 1 Whether the High Court has jurisdiction to resentence the petitioner after exhaustion of all appeals.
  2. 2 Whether the petition is res judicata in light of a previous decision by a court of concurrent jurisdiction.
  3. 3 Whether the change in law regarding mandatory minimum sentences applies to the petitioner.

Ratio Decidendi

Although the law regarding mandatory minimum sentences has changed, and the petitioner has exhausted all avenues of appeal, the petition for resentencing is res judicata due to a previous decision by a court of concurrent jurisdiction (Githinji J, March 18, 2021). The High Court cannot sit on appeal of a decision from a court of concurrent jurisdiction. Therefore, the court lacks jurisdiction to entertain the petition, and the application must fail on that basis.

Court Disposition

Petition dismissed for want of jurisdiction as res judicata.

Orders

  • The petition is dismissed as res judicata in view of the previous decision by Githinji J dated March 18, 2021.
  • This court has no jurisdiction to sit on appeal of a decision from a court of concurrent jurisdiction.
