Procedural Posture

Criminal Revision / Judgment

  1. 1 Whether the sentence imposed by the trial court exceeded the statutory maximum for a first offender under section 308(2) and (4) of the Penal Code.
  2. 2 Whether the applicant, as a first offender, was entitled to a lesser sentence than that imposed by the lower court.

Ratio Decidendi

The trial court erred in sentencing the applicant, a first offender, to seven years imprisonment for preparation to commit a felony under section 308(2) of the Penal Code, as the statutory maximum for a first offender is five years. There was no evidence of a previous conviction relating to property to justify a higher sentence. The High Court upheld the conviction but set aside the unlawful sentence, substituting it with a two-year term, which was then commuted to time served, resulting in the applicant's immediate release unless otherwise lawfully held.

Court Disposition

Orders
