The court found that although the delay in filing the appeal was inordinate, it was attributed to the mistake of the applicant's former counsel. While the applicant cannot simply blame his advocate, the court accepted that the grounds of appeal were not frivolous and that the applicant should not be denied a hearing on the merits due to counsel's error. The court granted leave to file the appeal out of time and allowed the new advocates to come on record.
