Both parties were found equally culpable for delays in the proceedings, and the court apportioned the delay, setting a new effective date for the rent increase at 1st January 1997. The court also found that the Tribunal erred in assessing a higher rent per square metre for the appellant than for other tenants in the same building without justification, and accordingly reduced the rent to match the rate previously determined for comparable tenants.
