Procedural Posture

Notice of Motion / Application to Set Aside Dismissal and Reinstate Suit

  1. 1 Whether the dismissal of the suit for want of prosecution was proper in light of the notice to show cause being served with an incorrect hearing date.
  2. 2 Whether the suit should be reinstated and set down for hearing on its merits.

Ratio Decidendi

The court found that the notice to show cause was served with an incorrect hearing date (15th July 2015 instead of 14th July 2015 as scheduled by the court). As a result, the plaintiffs and their counsel were not present when the matter was called out and the suit was dismissed for want of prosecution. The court acknowledged that this was a mistake on its part and accepted the plaintiffs' explanation for their absence. The court held that, in the interests of justice and to allow the matter to be heard on its merits, the dismissal order should be set aside and the suit reinstated.

Court Disposition

Application allowed; dismissal order set aside; suit reinstated.

Orders

  • The dismissal order of 14th July 2015 is set aside.
  • The suit is reinstated and admitted to hearing.
