There was no evidence that the Claimant was issued with a show cause letter or afforded a disciplinary hearing prior to dismissal. The Respondent's assertion of absenteeism was unsubstantiated, and the procedural requirements under the Employment Act were not met. Consequently, the dismissal was held to be unfair and unjustified. The Claimant was awarded one month's salary in lieu of notice, unpaid January 2014 salary, and ten months' salary as compensation for unfair dismissal, less statutory deductions. Costs were also awarded to the Claimant.
