1. The application dated 8/4/2025 sought an order staying proceedings in Chuka CMC E&L Case No E035 of 2024. Although the interested parties filed a replying affidavit opposing it, they have had a change of mind and they have elected to concede to the application for the sake of an expeditious disposal of this petition. The respondents did not respond to the application.
2. In the absence of any opposition to the application, the court will grant an order staying proceedings in Chuka CMC E&L Case No E035 of 2024 for a period of 9 months only. The petitioners are expected to prosecute their petition and procure a determination within the 9 months.
