Procedural Posture

Environment and Land Petition / Ruling on Application to Review, Vary, or Set Aside Previous Orders and on Jurisdiction to Entertain Withdrawal of Notice of Appeal

  1. 1 Whether the Environment and Land Court has jurisdiction to entertain the withdrawal of a notice of appeal once filed.
  2. 2 Whether the applicant is entitled to review, variation, or setting aside of the court's orders after lodging a notice of appeal.
  3. 3 Whether the applicant should be enjoined as an interested party in the petition.

Ratio Decidendi

The court held that its jurisdiction to deal with the notice of appeal terminated upon the lodging of the notice, and any withdrawal or striking out of the notice of appeal is within the exclusive mandate of the Court of Appeal. Since the applicant had already filed a notice of appeal against the orders he sought to review, the court lacked jurisdiction to entertain the application for review, variation, or setting aside of those orders. The law is clear that a party cannot seek review of an order once an appeal has been preferred. Consequently, the application dated 26 November 2024 was struck out for want of jurisdiction, with no order as to costs.
