Further, the application for stay of execution was incompetent because it was filed before the notice of appeal, contrary to the requirements of Order 42 Rule 6(4) of the Civil Procedure Rules and Rule 77 of the Court of Appeal Rules. The subsequent filing of the notice of appeal could not retrospectively validate the application.
