Civil Case / Ruling on Application to Amend Order
Legal Issues
- 1 Whether the court should amend its previous order to include L.R. SOUTH THARAKA/TUNYAI “A”/433.
- 2 Whether the application is facilitative of the implementation of the court's previous orders.
Ratio Decidendi
The court found that the application to amend the previous order was merely facilitative of the implementation of its earlier orders. Since the amendment sought was procedural and necessary to give effect to the court's decision, and there was no substantive opposition or prejudice demonstrated, the court exercised its discretion to allow the amendment. The court emphasized its inherent power to ensure that its orders are effective and can be implemented as intended.

CIVIL CASE NO. 38 OF 1989
MUTHAU MEENI.....................................................................APPLICANT

PHARIS GITAU KAGONDU...................................................RESPONDENT
R U L I N G
This application is dated 29th June, 2009. It seeks orders that;
(a) The order issued by this Court on the 2. 12. 2008 be amended to include/add L.R.SOUTH THARAKA/TUNYAI “A”/433 IN THE ORDER.
(b) Costs be in the cause.
This court gave an order for the reconstruction of the file on 2. 4.2014 as it had been lost and could not be traced for years.
I find that this application is merely facilitative of the implementation of this Court's orders. I do allow it.
It is so ordered.
