Ratio Decidendi

The Court of Appeal held that only a widow surviving at the time of confirmation of grant and distribution can be considered as a unit for purposes of section 40 of the Law of Succession Act. Since Joyce Wairimu Mungai (the first wife) died before confirmation of grant, she could not be counted as a unit in the distribution. The correct ratio for distribution between the two houses is therefore 5:5, reflecting the five children of the first house and the four children plus the surviving widow in the second house.
