The intended appeal was deemed arguable, and no prejudice to the respondents was demonstrated. On the issue of stay, the court held that the applicant had shown the risk of substantial loss if execution proceeded and the respondents' financial capacity was unknown. The court exercised its discretion to grant leave to appeal out of time and stay of execution, subject to the applicant depositing Ksh. 1,000,000 with the court within 14 days and filing the record of appeal...
