The High Court found that the trial magistrate erred in adopting a multiplicand of Kshs. 13,572/- for loss of dependency without evidentiary or legal basis, as there was no documentary proof of the deceased's income and the applicable minimum wage at the time of death was Kshs. 5,436/-. The court held that dependency was sufficiently proved by the chief's letter and uncontroverted testimony, but the correct approach was to use the gazetted minimum wage for unskilled workers. The dependency ratio of 2/3 and a multiplier of 28 years were accepted as undisputed.
