The court found that at the time of the purported sale agreement on 8th April 2000, the defendants were not the legal owners of the land, which was registered in the name of a deceased person. The defendants only became personal representatives after grant of letters of administration in 2010, and the law prohibits sale of immovable property of a deceased person before confirmation of grant. The agreement was thus illegal, null, and void for want of capacity and for contravening Sections 45 and 82 of the Law of Succession Act. The plaintiff's entry and occupation of the land was also in contravention of the law. However, the court found that the plaintiff did pay the full purchase price...
