The police abstract, while not conclusive, corroborated the respondent's testimony. The trial court was therefore entitled to find the appellant 100% liable. On the issue of quantum, the court held that while the respondent suffered serious injuries resulting in 40% permanent disability, the award of Kshs.800,000/- was inordinately high compared to similar cases.
