Ratio Decidendi

The Tribunal found that the tenant's reference was filed within the statutory period and was therefore validly before the Tribunal. However, the tenant failed to provide evidence of rent payment to counter the landlord's claim of arrears. The law places the burden of proof on the party alleging compliance, and the tenant did not discharge this burden. The landlord established valid grounds for termination under Section 7(1)(b) and (g) of Cap 301, namely persistent non-payment of rent and intention to use the premises for personal business.
