The court found that the applicant had provided a valid explanation for the short delay in filing the appeal, namely that judgment was delivered in their absence and they became aware only after the appeal period had lapsed. The right to appeal should be balanced with the respondent's right to enjoy the fruits of judgment, but substantive justice requires that the applicant be allowed to challenge the judgment on merit. The respondent's assertion of ability to refund the decretal sum was unsupported by evidence of means, and the sum involved was substantial, creating a real risk of irrecoverability if paid out. The applicant's offer of a bank guarantee as security was reasonable....
