Technically, the trial court erred by amending the charge after the close of prosecution evidence and failing to comply with the mandatory requirements of section 214 of the Criminal Procedure Code, namely, calling upon the accused to plead to the amended charge and offering an opportunity to recall witnesses. This rendered the subsequent proceedings fatally defective. Substantively, the evidence established that the complainant was above 17 years and acted in a manner that could reasonably deceive the appellant into believing she was over 18 years.
