Although there was inordinate delay in filing the application, the Applicant provided a reasonable explanation, namely the hospitalization of his advocate and lack of timely communication. The Applicant also expressed willingness to provide security for costs, and the court exercised its discretion to require a deposit of Kshs. 200,000 as security.
