Ratio Decidendi

The trial court erred in sentencing the appellant to 10 years imprisonment for threatening to kill when he had pleaded not guilty to that charge and was not tried or convicted for it, violating his constitutional right to a fair hearing. The conviction and sentence for threatening to kill were therefore quashed and set aside. However, the appellant's guilty plea to malicious damage to property was unequivocal, and the sentence of one year imprisonment was within the statutory maximum and reasonable in the circumstances. The conviction and sentence for malicious damage to property were upheld.
