Ratio Decidendi

The Court of Appeal found that the applicants had demonstrated an arguable appeal, particularly on the issues of whether change of ownership affects acquisition rights by adverse possession and when time starts to run in respect of a charge on the land. The Court also held that if the injunction was not granted, the applicants risked losing occupation of the suit land, and if the appeal succeeded, it would be difficult to recover possession, thus rendering the appeal nugatory. Both limbs for grant of relief under rule 5(2)(b) of the Court of Appeal Rules were satisfied, warranting the grant of the injunction pending appeal.
